Social Security Disability Benefits
SSA generally offers two types of disability benefits: Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI). SSDI is based on the credits from work that you have done in your life while SSI is a need based program. You must be found disabled by Social Security before you are entitled to either benefit.
After you apply for benefits, your case will be sent to Disability Determination Services (DDS). DDS makes the initial and reconsideration disability decisions for the Social Security Administration in North Carolina (each state has a different name for their local DDS).
Getting Started with your Social Security Disability case
Step One: Call The Bishop Law Firm at (919) 615-3095 for your free case review or start online now.
Step Two: File a claim with the local Social Security Office. The local office is at 3315 Poole Road, Raleigh, NC. Their phone number is 800-772-1213. You may want to call ahead. You may also be able to file online. When you file this claim you will need the following information.
When you file for Social Security Disability, it is important to inform SSA of every impairment that you feel is preventing you from working. Also, let SSA know if you are a veteran with a 100% P&T rating. Leaving out important information can slow down the processing of your claim, especially if you may otherwise be eligible for a Compassionate Allowance or expedited veteran processing.
Step Three: If you go anywhere new for treatment, take any new medication, or have any new diagnoses, you need to call us so we can forward that information on to DDS. If you are unrepresented you will need to call your examiner at DDS and let them know about your updates. Unfortunately, informing DDS does not guarantee that they will update your records but it is still your duty to let them know.
Step Four: After you apply for benefits, a DDS' examiner will be assigned to your case. The examiner may send you forms to fill out and may also send forms to 3rd parties for them to give their opinion about your daily activities. It is extremely important that you complete these forms as soon as possible and return them to the DDS examiner. In addition, DDS may send you to a consultative examination.
Step Five: You should continue to obtain medical treatment and follow all medical advice. If you are unable to obtain medical treatment due to cost, you should try free or low cost clinics, Duke Charity Care or UNC Charity Care, apply for help with prescription costs and apply for Medicaid for the Disabled at Social Services.
Step Six: DDS denies almost 75% of the cases that they see. If you receive a denial from DDS, you must appeal within 60 days or you will have to start the process from the beginning. You should inform your lawyer immediately if you receive anything in the mail from DDS.
Most claimants have to go on to the hearing level to have their claim approved but you must appeal each of the two DDS denials in order to request a hearing. For more on the process, read Raleigh Social Security Disability Lawyer.
